Terms of Service

1. Acceptance of These Terms

By downloading, installing, or using the Aligned App (“Aligned”, “the App”, “the Service”), you agree to be bound by these Terms of Service (“Terms”). These Terms form a binding agreement between you and Rosa Van Kuyk trading as Aligned App (“we”, “us”, “our”). If you do not agree to these Terms, do not use the App.

2. Description of the Service

Aligned is a personal health and self-development application designed to help women understand their menstrual cycle, track emotional patterns, and develop self-awareness through journaling, habit tracking, and AI-assisted insights powered by Anthropic’s Claude Sonnet model.

3. Not Medical or Psychological Advice

AI-Generated Outputs Are for Personal Reflection Only

Aligned uses artificial intelligence (Anthropic’s Claude Sonnet) to generate personalised insights based on the information you provide. These outputs are generated for the purpose of personal reflection and self-awareness only. AI-generated outputs:

• Are not based on clinical assessment
• Are not reviewed by medical or psychological professionals
• May not be accurate, complete, or appropriate for your individual circumstances
• Should not be relied upon to make decisions about your health, relationships, medication, employment, or any other significant life matter

To the maximum extent permitted by Australian law, Aligned App accepts no liability for any loss, harm, distress, injury, or other consequence arising from your reliance on any AI-generated output produced by the Service.

4. Eligibility

You must be at least 18 years of age to use Aligned. By creating an account, you confirm that you are 18 or older. If we become aware that a user is under 18, we will terminate the account and delete associated data.

5. Account Creation and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at info@alignedapp.com.au if you suspect unauthorised access.

6. Acceptable Use

You agree not to:

• Use the App in a way that breaches any applicable law or regulation
• Attempt to gain unauthorised access to our systems or infrastructure
• Reverse engineer, decompile, or extract source code from the App
• Use automated tools or bots to interact with the App
• Use the App for commercial purposes without our prior written consent

7. Your Content

You retain ownership of all content you create within Aligned, including journal entries, mood logs, and cycle data. By using the Service, you grant Aligned a limited, non-exclusive licence to process your content solely to provide the Service to you, including transmitting relevant data to Anthropic to generate insights. We do not use your content for advertising, sale to third parties, or any commercial purpose other than providing the Service.

8. Intellectual Property

All intellectual property in the Aligned App — including its design, code, branding, features, and AI model integration — is owned by Aligned App or licensed to us. Nothing in these Terms transfers any intellectual property rights to you.

9. Third-Party Services

Aligned integrates with Supabase (database and authentication) and Anthropic (AI processing). Your use of these services through Aligned is subject to those providers’ terms and privacy policies.

10. Disclaimers

To the maximum extent permitted by law, the App is provided “as is” and “as available” without warranties of any kind. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right under the Competition and Consumer Act 2010 (Cth) that cannot be excluded.

11. Limitation of Liability

To the maximum extent permitted by Australian law, Aligned App’s total liability to you for any claim arising out of or in connection with these Terms or your use of the App is limited to the amount you paid us in the 12 months preceding the claim (or AUD $100 if no amount was paid). We are not liable for any indirect, incidental, special, consequential, or punitive loss or damage.

12. Suspension and Termination

You may stop using Aligned and delete your account at any time via Settings or by contacting info@alignedapp.com.au. We may suspend or terminate your access if you breach these Terms or engage in unlawful conduct. Upon account deletion, your data will be handled in accordance with our Privacy Policy.

13. Governing Law

These Terms are governed by the laws of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Victoria for the resolution of any dispute. Before commencing any formal dispute process, please contact us at info@alignedapp.com.au to attempt resolution directly.

14. Changes to These Terms

We may update these Terms from time to time. Where changes are material, we will notify you in advance. Continued use of the App after notification constitutes acceptance.
